Welcome to Regulate. Please read these Terms of Service ("Terms") carefully before using the Regulate mobile application ("App") operated by Just Orange Labs Inc. ("we," "our," or "us").
By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Important Medical Disclaimer
REGULATE IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.
- The App is designed as a tracking and organizational tool for parents and caregivers of children with ADHD or other neurodevelopmental conditions.
- Information recorded in the App is for informational purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment.
- Always consult with a qualified healthcare provider before making any decisions about your child's medication, treatment, or care.
- Medication tracking features are intended to help you organize information to share with your healthcare providers—they are not medical recommendations.
- We make no representations or warranties about the accuracy, completeness, or suitability of any information in the App for any medical purpose.
AI-Generated Insights
The App includes AI-powered features that analyze your tracking data and generate insights, summaries, and suggested questions for healthcare providers. These AI-generated outputs:
- Are created by artificial intelligence (Anthropic's Claude AI), not medical professionals
- May contain errors, inaccuracies, or miss important patterns
- Should be verified by you and discussed with your healthcare provider
- Are provided for informational purposes only and do not constitute medical advice
- Should never be relied upon as the sole basis for medical decisions
2. Eligibility
To use the App, you must:
- Be at least 18 years of age (or the age of majority in your jurisdiction)
- Be a parent, legal guardian, or authorized caregiver of the child whose information you enter
- Have the legal authority to consent to these Terms
By using the App, you represent and warrant that you meet these eligibility requirements.
3. Account Registration and Security
Your Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials
- You must provide accurate and complete information when creating your account
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
Account Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You provide false or misleading information
- Your account is used for unauthorized purposes
4. Acceptable Use
You Agree To:
- Use the App only for its intended purpose of tracking your child's health and behavior
- Provide accurate and truthful information in all log entries
- Respect the privacy of other caregivers who share access to your child's profile
- Keep invite codes confidential and share them only with trusted caregivers
You Agree Not To:
- Use the App for any illegal purpose
- Share your account credentials with others
- Attempt to gain unauthorized access to other users' data
- Interfere with the proper functioning of the App
- Use the App to collect or store information about other people without their consent
- Reverse engineer, decompile, or disassemble the App
5. Multi-Caregiver Data Sharing
When You Create a Child Profile
- You become the "Admin" with full control over that profile
- You can invite other caregivers by generating invite codes
When You Invite Caregivers
By inviting other caregivers to your child's profile, you acknowledge and agree that:
- Invited caregivers ("Contributors") will have access to all tracking data for that child, including historical data
- Contributors can view logs created by other caregivers
- Contributors can see other caregivers' display names and relationship types
- You retain the right to revoke any contributor's access at any time
When You Join as a Contributor
By joining a child's profile via invite code, you acknowledge and agree that:
- You will have access to the child's complete tracking history
- Your log entries will be visible to all other caregivers on that profile
- Your display name and relationship type will be visible to other caregivers
- The admin can revoke your access at any time without notice
6. Data Export and Sharing
- You may export tracking data as CSV files to share with healthcare providers
- You are responsible for how you use and share exported data
- Exported data may contain sensitive health information—handle it appropriately
- We are not responsible for any disclosure that occurs after you export data from the App
7. Intellectual Property
Our Rights
The App, including its design, features, content, and underlying technology, is owned by Just Orange Labs Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
Your Content
You retain ownership of the data you enter into the App. By using the App, you grant us a limited license to store, process, and display your data solely for the purpose of providing the App's services to you.
AI-Generated Content
Insights, summaries, and responses generated by our AI features are provided for your personal use. You may share this content with healthcare providers. The AI-generated content is created using Anthropic's Claude AI and is subject to their usage policies at https://www.anthropic.com/policies.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of any information
WE DO NOT WARRANT THAT:
- The App will be uninterrupted or error-free
- Defects will be corrected
- The App is free of viruses or harmful components
- The results of using the App will meet your requirements
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We shall not be liable for any loss of data, profits, or goodwill
- Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the past twelve (12) months (if any)
SPECIFICALLY, WE ARE NOT LIABLE FOR:
- Any medical decisions made based on information in the App
- Any harm resulting from medication tracking or treatment phase comparisons
- Any loss or corruption of your tracking data
- Any unauthorized access to your account due to your failure to maintain security
10. Indemnification
You agree to indemnify and hold harmless Just Orange Labs Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Any content you submit to the App
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by:
- Posting updated Terms in the App
- Updating the "Last Updated" date
Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App.
12. Termination
By You
You may stop using the App and delete your account at any time through the Settings menu.
By Us
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.
Effect of Termination
Upon termination:
- Your right to use the App ceases immediately
- We may delete your account and associated data
- Provisions that by their nature should survive termination will survive (including limitations of liability and indemnification)
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
14. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Just Orange Labs Inc. regarding your use of the App and supersede any prior agreements.
